Terms & Conditions

By accessing or using FajCars ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use FajCars. These terms apply to all visitors, buyers, dealers, and any other users of the Platform.

FajCars is an online marketplace that connects car buyers with car dealers and sellers in The Gambia. FajCars is a connection platform only — we do not buy, sell, own, or hold any vehicles listed on the Platform. We do not process payments, hold funds, or act as an agent for either buyers or sellers.

All transactions, negotiations, inspections, and agreements are made directly between the buyer and the seller. FajCars is not a party to any such transaction.

FajCars does not facilitate, process, or handle any payments between buyers and sellers. All financial arrangements are strictly between the parties involved. FajCars is not responsible for any payment disputes, fraud, or financial loss arising from transactions conducted through introductions made on the Platform.

Buyers are solely responsible for verifying the following before making any payment or commitment:

• The identity and legitimacy of the seller
• The physical condition of the vehicle
• The accuracy of the vehicle's described mileage, year, and specifications
• That the seller holds valid ownership documents for the vehicle
• That the vehicle has no outstanding liens, debts, or legal encumbrances
• Compliance with all applicable Gambian laws regarding vehicle purchase and registration

FajCars strongly recommends that buyers inspect all vehicles in person and seek independent verification before completing any purchase. FajCars will not intervene in or resolve any disputes between buyers and sellers.

By listing a vehicle on FajCars, sellers and dealers agree to:

• Provide accurate, truthful, and complete information about the vehicle
• Only list vehicles they legally own or are authorised to sell
• Respond promptly and honestly to buyer enquiries
• Not engage in deceptive, misleading, or fraudulent practices
• Remove or update listings promptly when a vehicle is sold

By listing a vehicle on FajCars and uploading images, sellers grant FajCars a non-exclusive, royalty-free licence to use those images for marketing and promotional purposes, including but not limited to social media posts.

FajCars will not alter, modify, or edit the images in any way that misrepresents the vehicle. Images will only be used to promote the FajCars platform and will not be sold or shared with third parties for commercial gain.

All listings submitted to FajCars are subject to review and approval by our moderation team before they are published. FajCars reserves the right to approve, reject, or remove any listing at its sole discretion, including listings that contain inaccurate information, prohibited content, or that violate these Terms.

Users must not:

• Post false, misleading, or fraudulent listings
• Attempt to scam, defraud, or deceive other users
• Use the Platform for any unlawful purpose
• Attempt to access other users' accounts or data
• Post content that is offensive, defamatory, or violates the rights of others
• Use automated tools to scrape or extract data from the Platform

FajCars reserves the right to ban or suspend any user who violates these rules.

FajCars provides the Platform on an "as is" basis. To the fullest extent permitted by law, FajCars disclaims all liability for:

• The accuracy or completeness of any vehicle listing
• The conduct of any buyer or seller on the Platform
• Any loss, damage, or injury arising from a transaction facilitated through FajCars
• Any technical errors, downtime, or interruptions to the Platform

FajCars reserves the right to update these Terms and Conditions at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the updated terms. We will update the "Last updated" date at the top of this page when changes are made.

These Terms and Conditions are governed by the laws of The Republic of The Gambia. Any disputes arising from the use of FajCars shall be subject to the jurisdiction of the courts of The Gambia.
